The following bulletin was received from the Department of Revenue and
has been sent to all Colorado Dealers and Lenders. However, if
individuals are purchasing a vehicle from an individual, it’s important
that the public be made aware of this new change in the law. It is our
desire to make sure everyone is notified of these changes prior to
making the trip into our office, especially when traveling from the
furthest ends of the county, so that your trip is not made in vain.

Regarding Title
Application Change
The DR 2395 Title and/or Registration Application has been changed to
require all vehicle owners to declare their intent of Joint Tenancy with
Rights of Survivorship (JTWROS) or Tenants in Common. The following
changes will be made:
The DR 2395 (Rev 02/22/11) changes include:

Joint Tenancy with
Rights of Survivorship Acknowledgement of Intent page has been added
-
Signature line for
all owners acknowledging intent
-
Date of signature
line for each owner

The Verification of
Vehicle Identification Number page has been removed and made a
separate form number DR 2698
-
Additional boxes
have been added for Lienholders to add a different address for the
title to be mailed. If no address is provided, the title will be
mailed to the first lienholder name and address provided on the
Title and/or Registration Application.

Confidentiality
statement added to the application for compliance with Colorado
Revised Statute (C.R.S.) 42-2-121 (4)(a)

“Any Alteration or
Erasure in this Area May Void this Document” wording has been added
and will apply to the top portion of the application only
-
An area for “County
Use Only” has been added below the application for clerks to use as
a worksheet

title in JTWROS will only be issued if all owners declare their intent
as such on either the DR2395 or DR 2574 form. If any owner chooses
Tenants in Common or has not declared their intent, the title will be
issued with Tenants in Common.
Please refer to 38-11-101, C.R.S., for additional information on joint
tenancy.
Previous
versions of the DR 2395 dated 06/30/09 may be accepted until July 1,
2011. On and after July 1, 2011, only the 02/22/11 version of the DR
2395 will be accepted in order to acknowledge intent.
If
you currently title all of your vehicles as Tenants in Common, this
change will NOT affect you. However, the majority of the titles
processed in our county are titles as JTWROS! You may call our office at
438-5421 to have a copy of this form faxed to you or you may go online
to Colorado Department of Revenue, Division of Motor Vehicles, Forms &
Publications, Form # DR 2395 and print this form. As of July 1, 2011, if
all parties/owners assigned on the title are not coming in to our office
at the time of processing the title, this form MUST be signed prior to
coming in to our office. If not, the title will be processed as Tenants
in Common. Please feel free to contact our office is you have any
